ACCEPTABLE USE POLICIES, TERMS and CONDITIONS
of bushnell.net
bushnell.net is a service of
Infobahn Outfitters, Inc. of Macomb,
Illinois.
- bushnell.net reserves the right to
modify the Acceptable Use Policy at any time. Modified policies become
effective when posted to this Web Address (URL):
http://homepage.bushnell.net/aup.html. Accounts that utilize services from other entities are subject
to the AUP of those entities
(such as <http://www.frontiernet.net/technicalsupport/security/acceptable.html>).
- bushnell.net exercises no control over
and denies any responsibility for the content, accuracy or quality of the
information which passes through its networks or any products ordered by
customers via its networks. bushnell.net makes
no warranties of any kind, express or implied, for the service it provides.
bushnell.net will not be responsible for any damage
you suffer from use of the service. This includes, but is not limited to, loss
of data resulting from delays, non-deliveries, mis-deliveries, or service
interruptions caused by its own negligence or your errors or omissions or due
to inadvertent release or disclosure of information sent by users. We
highly recommend the use of anti-virus software and personal firewalls.
- Any liability or indemnification of
bushnell.net, including but not limited to any
liability for damages caused or allegedly caused by any failure of performance,
error, omission, interruption, defect, or delay, shall be strictly limited to
amount paid to bushnell.net by or for the customer
for the service during the current month.
- The network and services of bushnell.net
may be used only for lawful purposes. Unlawful purposes include, but are not
limited to, transmission of threatening or obscene material; transmission or
use of copyrighted material, including software, without owner's authorization;
transmission of trade secrets; transmissions which violate export laws;
unauthorized entry on local or remote computers or assistance to others doing
so. Assistance includes, but is not limited to distribution of passwords.
- Resale and reassignment of services of
bushnell.net are strictly prohibited.
- Account termination will be accepted by written notification.
Early contract termination charges may apply. Additional charges may
apply for equipment owned by Infobahn Outfitters and not returned in
functional order within 10 days of termination. Refer to contract for details.
Dialup and wireless accounts that remain unpaid 10 days after the invoice
date may have service interrupted. Satellite and DSL services may be
terminated immediately if payment is not received prior to due date.
Re-connect fees may apply. Service interruption does not relieve
the customer from obligation of monthly charges. Any checks submitted
as payment for service which are returned unpaid will be subject to a
returned check fee of up to $25.00.
- Accounts with web space that exceed the disk storage or file
transfer quotas for the package purchased are subject to review. Customers
exceeding the quotas may choose to upgrade or to discontinue their account.
Refer to descriptions of access packages for specific details.
Note: Posting of World Wide Web pages of a commercial nature is permitted.
- bushnell.net has the right to terminate
or suspend service at any time for any reason. Liability for termination or
suspension shall be strictly limited to amount paid to
bushnell.net by or for the customer for the service
during the current month.
- A single account is for use by members of a single household or
business only, provided only a single attended connection to the network is
established via that account at any given time. Residential broadband
(wireless, satellite, and DSL) is not intended as a replacement for
high-capacity, dedicated access. Infobahn Outfitters offers
dedicated access accounts to customers who wish to operate servers
for web, mail, ftp, chat, KaZaA, Morpheus and other similar services.
Implementation of such services is not permitted with non-dedicated access
accounts.
- Dialup accounts offered as unmetered access are subject to disconnection after 20 minutes of inactivity. Programs or methods used to
maintain a connection while a person is not using the connection (commonly
known as "keep-alive programs") are forbidden. The first detection of such a
method will result in a warning. The second detection will result , at the
discretion of bushnell.net, in either the
termination of the account or billing at the rate for a dedicated connection.
- Violation of the policies stated within this document may result in
the immediate termination of the subscriber's services.
- bushnell.net provides NO archival
services for accounts of subscribers. Subscribers are encouraged to archive
electronic mail and other files which they deem valuable.
- Subscribers to bushnell.net services
should recognize that some material on the Internet, including but not limited
to the World Wide Web and Usenet newsgroups, are intended for adult audiences
or may be offensive to some. Account holders under 18 years must have written
permission of parent/legal guardian. Account holders have sole responsibility
for those using their account, including supervision of any person under 18
years of age.
- bushnell.net recommends that subscribers
familiarize themselves with generally accepted rules of etiquette (commonly
called "netetiquette") on the Internet using information provided through the
World Wide Web. Breaches of etiquette include, but are not limited to,
attempting to violate security, sending unsolicited mass electronic mailings
of any nature, posting
unsolicited messages to a large number of Usenet newsgroups, attempting to
flood any electronic mail box with a large number of messages or a single
large message, forging electronic mail headers, creating or participating
in chain letters, sending harassing electronic mail, distributing pornographic,
indecent, or offensive materials, distributing restricted software or materials
in violation of copyrights or distribution licenses, or using the service to
violate any and all local, state or federal statutes.
Flagrant, intentional, continuing or repeated breaches of
Internet etiquette may result in termination of subscription services.
- In the event that customer violates the terms of this agreement,
customer indemnifies bushnell.net for all
fines, penalties, judgements or other costs which
bushnell.net may incur as a result of the
customer's violation under the terms of this policy. In addition,
customer shall and will pay to bushnell.net
all costs and expenses, including attorney's fees, incurred by
bushnell.net in any action or proceeding
to which it may be made a party as a result of this agreement or as a result of enforcing this agreement.
